For these reasons it is decided that:
1. The appeal is dismissed.
2. The appellant shall bear the following costs incurred by the respondent for attending the oral proceedings on 19 March 2013:
- travel costs;
- accommodation costs for one night;
- five hours preparation and attendance time.
