For these reasons it is decided that:
1. The appeal of opponent 2 is admissible.
2. The request to refer a question to the Enlarged Board of Appeal is rejected.
3. The proprietor's Rule 106 EPC objection is dismissed.
4. The decision under appeal is set aside.
5. The patent is revoked.
