Etant donné que les dispositions du point 6 du communiqué du Vice-Président chargé de la direction générale 2, en date du 28 avril 1999, visant à confier aux agents des formalités certaines tâches incombant normalement aux divisions d'opposition de l'OEB (JO OEB 1999, 506) sont en conflit avec des dispositions d'un rang supérieur, à savoir les règles 9(3) et 56(1) CBE, ce sont ces dernières qui font foi, par analogie avec les dispositions de l'article 164(2) CBE. Par conséquent, la compétence pour statuer sur l'irrecevabilité de l'opposition appartient à la division d'opposition et ne peut être confiée à un agent des formalités.
