- Wird das Prioritätsrecht für eine europäische Patentanmeldung oder ein darauf erteiltes europäisches Patent aufgrund einer früheren europäischen Patentanmeldung nicht wirksam in Anspruch genommen, weil es sich wegen eines nur in der jüngeren europäischen Patentanmeldung vorhandenen "Disclaimers" nicht um "dieselbe Erfindung" im Sinne von Artikel 87(1) EPÜ und der Entscheidung G 2/98 handelt, ist der Inhalt der früheren und nachveröffentlichen europäischen Patentanmeldung als Stand der Technik im Sinne von Artikel 54(3) EPÜ, Artikel 54(4) EPÜ 1973 (vgl. hierzu Artikel Nr. 1 des Beschlusses des VR vom 28. Juni 2001 über die Übergangsbestimmungen nach Artikel 7 der Akte zur Revision des EPÜ vom 29. November 2000) anzusehen.
ENTSCHEIDUNGSFORMEL
Aus diesen Gründen wird entschieden:
Die Beschwerde wird zurückgewiesen.
