Rules relating to Fees - Decisions
Erratum OJ EPO March 2012
OJ EPO 3/2012, page 213: footnote number 2 is incorrect and should be replaced by the following wording:
"² In the special cases mentioned in footnote 1, under RFees 2012 the search fee amounts to EUR 1 165 and the examination fee to EUR 1 555."
OJ EPO 3/2012, page 217: last paragraph of section 3, the amount of the examination fee is incorrect. The correct amount should be replaced in accordance with the following wording:
"- If the international application was filed on or after 1 July 2005, the fee for the supplementary European search is EUR 1 165. The examination fee is EUR 1 555."
OJ EPO 3/2012, page 220 (German version), page 221 (English version), page 222 (French version): diagram "Amounts of search and examination fees applicable to payments made from 1 April 2012". The correct amount of the reduced examination fee is EUR 777.50 (incorrect amount EUR 775.50/755.50) where the ISA was AT, ES, FI, SE or XN and the EPO drew up the IPER.
OJ EPO 3/2012, page 221: diagram "Amounts of search and examination fees applicable to payments made from 1 April 2012" (English version only). The search fee for a supplementary European search report is correctly given as EUR 175 if the ISA was AT, ES, FI, SE or XN, but this fee is calculated as follows: EUR 1 165 minus EUR 990 (not EUR 940).
OJ EPO 3/2012, page 266: the fee for issuing a certified copy (code 029) is incorrect; the amount should be EUR 50 rather than EUR 20. The PCT fee reduction for filing in electronic form where the request is in character-coded format (code 318) is incorrect; the amount should be EUR 165 rather than EUR 167:
" - Fees for international applications:
Issue of a certified copy of a European patent application or an international application (priority document)
R. 17.1(b) PCT; R. 54 EPC - Code 029 = EUR 50.00
- PCT reduction for filing in electronic form - Code 318 = EUR 165.00"
The electronic version of OJ EPO March 2012 has been corrected accordingly.
