For these reasons it is decided that:
1. The decision under appeal is set aside.

The case is remitted to the opposition division with the order to maintain the patent on the basis of auxiliary request 1 as submitted during the oral proceedings before the board (consisting of claims 1 to 9 of the main request, i.e. the set of claims held allowable by the opposition division) and a description to be adapted to this request.
