For these reasons it is decided that:
1. The appeal is dismissed.
2. The decision under appeal is set aside.
3. The case is remitted to the first instance with the order to maintain the patent on the basis of claims 1 to 5 filed with the letter of 19 March 1997 and a description to be adapted.
