- Leitsatz
When a decision to terminate opposition proceedings, taken in written proceedings, is handed over to the EPO postal service, it becomes public and effective and has therefore been issued. If the parties to the proceedings do not appeal, the opposition proceedings are completed at that point in time and thereafter intervention based on Article 105 EPC is no longer possible.

ORDER
For these reasons it is decided that:
1. The appeal is dismissed.
2. The request to refer a point of law to the Enlarged Board of Appeal is refused.
3. The request to order the appellants to pay the respondents' oral proceedings costs is refused.
