The applicant has the right to reduction of the examination fee, when the requirements provided for in Articles 14(2)(4) and 94(2) EPC are fulfilled, which in circumstances such as those of the present case may indeed be satisfied, even though the request for examination in an official language of a contracting state other than English, French or German has not been filed together with the request for grant.

ORDER
For these reasons it is decided that:
1. The decision under appeal is set aside.
2. The case is remitted to the first instance with the order to refund to the appellant the 20% examination fee and the 50% surcharge over the full amount of the examination fee.
3. The request for reimbursement of the appeal fee is rejected.
