Aus diesen Gründen wird entschieden:
1. Die angefochtene Entscheidung wird aufgehoben.
2. Die Angelegenheit wird an die erste Instanz zurückverwiesen mit der Anordnung, das Patent in der geänderten Fassung gemäß den Ansprüchen 1 bis 7 des Hilfsantrags 4, eingereicht mit der Beschwerdebegründung, und einer noch anzupassenden Beschreibung aufrechtzuerhalten.
