- Alerting a party to a possible argument against him and on a ground on which the burden of proof rests on him, in advance of the oral proceedings, would amount to a clear violation of the principle of impartiality, irrespective of the fact that the communication setting out such an argument would also be sent to the other party.
ORDER
For these reasons it is decided that:
1. The decision under appeal is set aside.
2. The main and first auxiliary requests are dismissed.
3. The case is remitted to the Opposition Division with the order to maintain the patent on the basis of the second auxiliary request and after any necessary amendment to the description.
