For these reasons it is decided that:
1. The decision under appeal is set aside.

The matter is remitted to the first instance for further prosecution on the basis of the claims 1 to 15 of auxiliary request 2 submitted on 10 January 2003 for the Contracting States AT, BE, CH, DE, DK, FR, GB, GR, IT, LI, LU, NL, SE, and claims 1 to 8 submitted at the oral proceedings on 14 February 2003 for the Contracting States ES.
