ORDER

For these reasons it is decided that:

1. The decision under appeal is set aside.

2. The case is remitted to the first instance with the order to grant a patent on the basis of the following application documents as agreed by the Board of Appeal:

Description: pages 1, 1A, 2, 2A, 3, 4, 4A, 5, 5A and 6 as filed with the letter dated 12. September 1996, whereby the passage ", in which bottom ... beneath said plate" on page 1, lines 16 to 21 is deleted;

Drawings: sheets 1/2 and 2/2 as originally filed.

3. The request for reimbursement of the appeal fee is allowed.
