Order
For these reasons it is decided that:
1. The appeals of the patent proprietor and opponent 2 are
admissible.
2. The request for referral to the Enlarged Board of Appeal is
refused.
3. The objection under Rule 106 EPC is dismissed.
4. The decision under appeal is set aside.
5. The case is remitted to the department of first instance for
further prosecution.
