The question whether a claims fee is due under Rule 31(1) EPC has to be considered already in the course of the initial examination of the application as to formal requirements irrespective of whether at a later stage, as a consequence of the outcome of the substantive examination, such a fee may become due under Rule 31(2)in conjunction with Rule 51(4) EPC.
