Role of the Legal Board of Appeal
The Legal Board of Appeal is responsible for reviewing first-instance decisions on issues of an essentially procedural nature. It is competent to hear appeals from decisions of the Receiving Section and the Legal Division. In certain cases, it also decides on appeals against decisions of the Examining Divisions, provided that the appealed decision does not concern the refusal of a European patent application or the grant, limitation or revocation of a European patent.
Composition
The Legal Board of Appeal is composed of three legally qualified members, designated in accordance with the business distribution scheme of the Legal Board of Appeal adopted by the extended Presidium.
