Considering the general requirements of Article 113(1) EPC, i.e. the parties' right to be heard, no reasons for a procedural violation committed by the Examining Division have been submitted by the Appellant nor could these be found by the Board, so that there is no ground for a reimbursement of the appeal fee in accordance with Rule 67 EPC. ORDER
For these reasons, it is decided that:
1. The decision under appeal is set aside.
2. The case is remitted to the first instance for further prosecution.
