ORDER

For these reasons, it is decided that:

1. The decision under appeal is set aside.

2. The appellant is restored in his rights as far as the payment of the national fee, the search fee and the designation fee within the time limit under Rule 85(a) EPC is concerned.

3. The application for restitutio in integrum in respect of he time limit under Rule 85(b) EPC is remitted to the Receiving Section for further prosecution.

4. Reimbursement of the appeal fee is ordered.
