Patent litigation in Europe: (Un)resolved procedural issues in the UPC
This advanced lecture series is dedicated to examining current topics in patent litigation in Europe, including the launch of the UPC and the emergence of new European patent jurisprudence. The series feeds the content of and leads up to the annual Litigation Matters conference. Participants can attend each session separately or the entire series. It is organised by the EPO in co-operation with the European Patent Lawyers Association (EPLAW) and the European Patent Litigators Association (EPLIT) .
This third lecture, entitled “(Un)resolved procedural issues in the UPC” is held by Willem Hoyng, Chairperson of the UPC Advisory Board. It will be followed by a Q&A session. Willem will discuss the first year, when many procedural issues have been decided for certain issues but where the rules do not seem to provide a solution and/ or are unclear. The seminar highlights some of them, and participants may raise others for which solutions will be discussed. Willem Hoyng holds an LLM from Leiden University and obtained his PhD from Tilburg University, where he was appointed Professor of IP Law in 1988. He has been practising IP law since 1973 and has been admitted to the bar of the Supreme Court of The Netherlands. He has represented clients before all levels of the national courts of the Netherlands. He has regularly litigated before the Court of Justice of the European Union and the European Patent Office and has advised on patent litigation strategy for both Dutch and foreign multinationals. He chairs the Advisory Committee of the UPC, participated in drafting the Rules of Proceedings for the UPC, and advises the Dutch Ministry of Economic Affairs on UPC matters.
