Headnote

1. The statement "I reserve my right to request oral proceedings under Article 116 EPC" is not in itself an actual request for oral proceedings.

2. The right of a party to have oral proceedings under Article 116 EPC is dependent upon such party filing a request for oral proceedings. In the absence of such a request, a party has no right to such proceedings, and the EPO can issue a decision - whether adverse or not - without appointing such proceedings.
