ORDER
For these reasons it is decided that:
1. The impugned decision is set aside.
2. The case is remitted to the Opposition Division in order to carry out a full examination of the issue of Article 100(b) EPC including the evidence filed by the appellant in this respect.
3. The reimbursement of the appeal fee is ordered.
