Section 71, subsection: If the European Patent Office has rejected the request to grant the status of unitary effect to the European patent in accordance with Regulation (EU) No. 1257/2012 of the European Parliament and of the Council of 17 December 2012, implementing enhanced cooperation in the area of the creation of unitary patent protection of point (g) of paragraph 1 of Article 9, the proprietor of a European patent can request re-establishment of rights in Latvia in accordance with the provisions mentioned in paragraph 2 of this Article. The beginning of the three-month period is defined as the day when the decision of the European Patent Office on the rejection of the status of unitary effect has come into force.Specific provisions relating to safety net mechanism are under consideration and will be introduced later. |
