5.12 Filing of other documents

5.12.3.Certificate of exhibition 

5.12.004Where relevant, the certificate of exhibition is to be filed within the 31-month time limit. If the document is not filed in due time, the applicant's disclosure at the relevant exhibition will be taken into account for the purposes of establishing whether the invention claimed is new under Article 54 EPC. The relevant exhibitions falling within the terms of the EPC are published every year in the Official Journal.

5.12.005If the certificate is not filed in due time, the applicant is informed of this in a communication under Rule 112(1) EPC. The omission may be remedied by a request for further processing. The request will be granted if within two months of notification of the communication the certificate is furnished and the fee for further processing is paid.
