Chapter 5 – Euro-PCT procedure before the EPO as a designated or elected Office

5.17 State of the art 

5.17.001Upon payment of the filing fee (including any page fee) and, where required, receipt of the translation, an international application is considered as comprised in the state of the art under Article 54(3) EPC (see points 5.5.006 and 5.7.013). This means that a Euro-PCT application does not need to fulfil all conditions for entry into the European phase in order to be considered a conflicting European application under Article 54(3) EPC. Any Euro-PCT applications complying with Rule 165 EPC are published in the European Patent Bulletin in Section I.2(2).
