In both cases G‑V, 1(i) and G‑V, 1(ii), it is essential that the disclosure took place no more than six months before the application was filed. For calculating the six-month period the relevant date is the actual date of filing date of the European patent application, not the priority date (G 3/98 and G 2/99).
