Patent litigation in Europe : Mediation in resolving patent disputes
This lecture series is dedicated to examining current topics in patent litigation in Europe, including UPC litigation and the emergence of new European patent jurisprudence. The series feeds the content of and leads up to the annual Litigation Matters conference. Participants can attend each session separately or the entire series. It is organised by the EPO in co-operation with the European Patent Lawyers Association (EPLAW) and the European Patent Litigators Association (EPLIT).
This specific lecture will focus on mediation in resolving patent disputes. Various forms of mediation have been used for centuries to resolve disputes. More recently, various forms of mediation- non evaluative and evaluative as well as early neutral evaluation have become more common in patent disputes. The Patent and Mediation Centre of the UPC is a good recent example of this trend which provides specialist rules for use of these techniques for patent and FRAND disputes. The lecture will explain in detail the techniques and provide practical examples of where they can be successfully employed.

Alex Wilson, Partner
Alex Wilson is one of the founding partners of Powell Gilbert, a specialist European IP firm with offices in London, Düsseldorf and Dublin.
After gaining a BSc in Biochemistry from University College London, he entered the field of patents as a patent Examiner at the EPO. He then qualified as lawyer and has been practising as a specialist patent litigator for more than two decades. He is a UPC Representative, UK Solicitor Advocate, Irish, and New South Wales Solicitor. He has represented clients in a range of divisions of the UPC as well as the English and Australian courts and has a particular focus on guiding and supporting clients in international patent litigation strategies including in FRAND disputes. Alex has a particular interest in ADR, he has been a certified CEDR mediator since 2021 and acts regularly in patent arbitrations. He is registered with the Patent and Mediation Centre of the UPC as a mediator and arbitrator.
He is joint editor of an international commentary Unified Patent Court Procedure (2025) published by Beck/Hart, is a board member of European Patent Lawyers’ Association, (EPLAW) and leads its ADR Committee.
