2.7.3 Burden of proof, standard of proof and suitable evidence of valid transfer

Overview

a) Burden of proof

Prior to G 1/22 and G 2/22, the burden of proving a valid transfer of the right of priority lay with the proprietor since it was the one claiming that right (T 1201/14, see also J 19/87, T 1008/96, T 1056/01, T 493/06 and T 205/14). This was reversed in G 1/22 and G 2/22 (see in this chapter II.D.2.4.3).
