6. Change in composition of a board

Article 8 RPBA sets out the consequences of a change in the composition of a board. According to Art. 8(1) RPBA, if the composition of a board is changed after oral proceedings, the parties shall be informed that, at the request of any party, fresh oral proceedings shall be held before the Board in its new composition. In T 956/19 the board made clear that in view of Art. 8(2) RPBA any fresh oral proceedings would be restricted to any submissions not decided on in the preceding interlocutory decision.
