11. Examination of further formal requirements – non-compliance
11.3 Missing sequence listing
If a sequence listing in electronic form complying with the applicable WIPO standard is not available to the EPO on expiry of the 31-month time limit, the applicant will be invited to furnish the sequence listing and pay the late furnishing fee within a non-extendable period of two months in accordance with Rules 163(3) and 30(3).
If the required sequence listing is not filed and the late furnishing fee is not paid within the time limit set, the application will be refused. The refusal may be remedied by filing the standard-compliant sequence listing, paying the late furnishing fee and filing a request for further processing under Art. 121. Two fees for further processing are due for the omitted acts: a flat fee for late filing of the standard-compliant sequence listing and 50% of the late furnishing fee for the late payment.
