11.8 Payment of claims fees under Rule 162(1)
According to Rule 162(1), claims fees for a Euro-PCT application must be paid within the 31-month period under Rule 159(1). However, in view of Rule 162(2), a failure to pay them within that 31-month period has no consequences. For amendments made both before and after expiry of the 31-month period, Rule 162(2) provides that any claims fees may be paid up to expiry of the six-month period under Rules 161 and 162. There is therefore no loss of rights under Rule 163(3) if any claims fees are paid (only) within this period referred to in Rule 162(2). See A‑XIV, 2.2 for further information on claims fees and the procedure under Rule 162. Rule 162(1) is important in cases where the applicant wishes to waive the right to receive the communication under Rules 161 and 162 (A‑XII, 7.2).
