4. Review of filing date and priority claims considered void under Rule 82ter.1(a) PCT
For a request for review in relation to the filing date or a priority claim to be successful, the applicant must prove to the satisfaction of the EPO that the receiving Office erroneously accorded an incorrect filing date, or erroneously did not accord a filing date, or that it erroneously considered a priority claim not to have been made, and the EPO must then find that, had it made the error itself, it would rectify it under the EPC. If those requirements are met, the EPO must rectify the error and treat the international application as if it had been accorded the rectified international filing date or as if the priority claim had not been considered not to have been made.
