3.3.2 Correction of editing/formatting errors

The request for correction of editing/formatting errors is admissible and allowable (see H‑VI, 3.3). For the criteria for assessing whether the error indicated by the proprietor is an editing/formatting error and for examples, see H‑VI, 4.

In this case, the examining division:

–decides on the request and orders republication of the corrected patent specification within two weeks from remittal of the request by the opposition division, and

–informs the proprietor and the opposition division that the request is allowable and that the specification will be republished.

The proceedings continue on the basis of the corrected text.
