How do I request registration as a legal practitioner within the meaning of Article 134(8) EPC?
Pursuant to Article 134(8) EPC, any legal practitioner qualified in an EPC contracting state and having their place of business in that state, can undertake representation in proceedings before the EPO in the same way as a professional representative and to the extent that they are entitled in that state to act as a professional representative in patent matters.
If you fulfil the requirements of Article 134(8) EPC
and
have been authorised to act as a representative before the EPO, or you require registration as a legal practitioner as prerequisite for the registration as a member of an association of representatives under Rule 152(11) EPC, you can request registration either in MyEPO (for more information see the MyEPO feature guide: managing representative profiles and associations) or by using EPO Form 52307 (Request for registration as a legal practitioner with the EPO).
You must include the following with your request:
1. Evidence of your qualification as a legal practitioner, e.g. a certified copy of your bar association certificate. If that evidence is not in one of the EPO's official languages, also file a translation thereof in one of the EPO's official languages.
2. Evidence of current place of business/employment (if not apparent from evidence under point 1 above).
Please provide certified copies where official certificates are required as evidence. Certification may be performed by national authorities of the EPC contracting states, professional representatives registered on the list of professional representatives before the EPO as well as legal practitioners who are entitled to do so under national law. For evidence of your place of business or employment, if not apparent from evidence of being a legal practitioner, please file confirmation from your current employer or, for self-employed representatives, other appropriate evidence, e.g. evidence of tax/business registration.
