Can a WIPO Standard ST.26 sequence listing be filed after the date of filing?
Yes, a standard-compliant sequence listing can be submitted after the date of filing. However, it will not form part of the disclosure of the application and will only be used for search purposes (see Rule 30(2) EPC). As a consequence, it is not subject to examination under Article 123(2) EPC. The subsequently filed sequence listing must nevertheless be accompanied by the standard "statement" that the sequence listing does not contain subject-matter going beyond the application as filed. Therefore, if the sequences are essential features of the invention, special care should be taken to ensure that the sequence listing is not their only source.
