Can I request compensation for any translation related costs?
Yes, such compensation is available for SMEs, natural persons, non-profit organisations, universities and public research organisations fulfilling certain requirements.
The requester must:
a. have filed the European patent application or Euro-PCT application leading to the Unitary Patent in an official EU language that is not one of the EPO's official languages (English, French and German) and
b. have their residence or principal place of business in an EU Member State.
The request for compensation must be filed together with the request for unitary effect (Rule 9(1) UPR). The compensation scheme provides a lump sum of EUR 500 for translation costs (Article 4(1) RFeesUPP).
It should be noted that the compensation can only be granted after unitary effect has been entered in the Register for unitary patent protection (Rule 10(1) UPR).
