Overview

1. Documents subject to formal notification

R. 125(1) EPC was amended on 1 April 2015 to clarify the scope of documents subject to notification. The amended provision provides an explicit legal basis for the EPO's practice of not formally notifying notices and communications from which no time limits are reckoned (CA/D 6/14, OJ 2015, A17).

Hence, as a matter of course, the EPO notifies those concerned of decisions and summonses, and of any notice or other communication from which a time limit is reckoned, or of which those concerned must be notified under the EPC, or of which notification has been ordered by the President of the EPO (R. 125 EPC and notice of the EPO dated 30 March 2015, OJ 2015, A36). Other communications are not subject to formal notification.
