3.3.1.1 The requested correction has no effect on the outcome of the opposition proceedings

Where bibliographic data is not relevant to the substantive examination of a patent, the opposition division will continue the proceedings up to and including dispatch of the written (interlocutory) decision.

Where the (interlocutory) decision is to:

–reject the opposition or revoke the patent, the proceedings before the opposition division can be closed, even if the proceedings before the examining division are still open

–maintain the patent in amended form under Art. 101(3)(a) and Art. 106(2), the communication pursuant to Rule 82 will be dispatched only once the proceedings before the examining division have been closed.
