3.3.1.2 The outcome of the opposition proceedings depends entirely on the decision on the requested correction

Where the outcome of the proceedings depends entirely on the decision on the correction, the opposition division will adjourn the proceedings until the proceedings before the examining division are closed and after any subsequent republishing of the patent (B8 publication).

Examples where the correction could have an effect on the outcome of the opposition proceedings:

–A correction of the name of the applicant could influence the right to claim priority.

–A correction of the priority claim could affect the assessment of novelty and inventive step.
