Patent litigation in Europe : Added Matter at the EPO and UPC
This lecture series is dedicated to examining current topics in patent litigation in Europe, including UPC litigation and mediation and arbitration to solve patent disputes. The series leads up to the annual Litigation Matters conference. Participants can attend each session separately or the entire series. It is organised by the EPO in co-operation with the European Patent Lawyers Association (EPLAW) and the European Patent Litigators Association (EPLIT).
The EPO has developed its own standard for assessing the original disclosure when assessing whether amendments made during prosecution and opposition are allowable. This has been dubbed the “Gold Standard” by the EPO Boards of Appeal. Questions of validity of European Patents and Unitary Patents when challenged at the Unified Patent Court refer to the Articles of the EPC, and in particular the assessment of added matter under Article 123(2) EPC. Developing case law at the UPC has started to explain how the courts should apply Article 123(2) EPC and furthermore the meaning of the Gold Standard.
For Added Matter at the EPO and UPC, our lecturers will introduce the two sides of the practice: the EPO and the UPC. and provide some insights into the developing Court of Appeal decisions and how these may affect post-grant invalidity practices.
