Patent litigation in Europe : orders to Preserve Evidence (Saisie) at the Unified Patent Court
This lecture compares the procedure for preservation of evidence available under the UPCA with national “saisie” proceedings in some jurisdictions where this is common. These proceedings share the same core objective of enabling rapid, often ex parte collection of evidence of infringement before it can be concealed or destroyed, but there are key differences in structure and safeguards. The lecture will provide practical insights from an expert who has conducted such proceedings on behalf of national courts as well as the UPC.
