Gruppe B+
Die Gruppe B+ wurde eingerichtet, um bei zentralen Fragen, mit denen sich die Weltorganisation für geistiges Eigentum (WIPO) befasst, Fortschritte zu fördern und zu erleichtern und insbesondere bei der Harmonisierung des materiellen Patentrechts voranzukommen.
Zusammensetzung
Den Vorsitz führt Herr Pascal Faure, Generaldirektor des französischen Institut National de la Propriété Industrielle (INPI). Die Mitglieder der Gruppe B+ sind:
- alle Mitglieder der Gruppe B der WIPO,
- die Mitgliedstaaten der EU,
- die Europäische Kommission,
- die Mitgliedstaaten der EPO,
- das EPA und
- Südkorea.
Die WIPO und Singapur nehmen als Beobachter an den Sitzungen teil.
Ihre jährliche Plenarsitzung in Präsenz hält die Gruppe B+ normalerweise am Rande der WIPO-Generalversammlung in Genf ab.
Untergruppe
2014 wurde zur Unterstützung des Vorsitzenden eine Untergruppe B+ eingesetzt, der momentan Vertreter Australiens, Dänemarks, Deutschlands, Japans, Kanadas, Schwedens, Südkoreas, Spaniens, Ungarns, der USA, des Vereinigten Königreichs und des EPA angehören.
Die Untergruppe befasst sich mit einem Paket anhängiger Fragen, und zwar:
- unschädliche Offenbarungen/Neuheitsschonfrist,
- Veröffentlichung von Anmeldungen,
- kollidierende Anmeldungen,
- Vorbenutzungsrechte und
- Stand der Technik.
Obwohl die Ansichten auseinandergehen, welche Elemente zur optimalen Praxis gehören, ist die Untergruppe bei der Definition mehrerer für die behandelten Fragen maßgeblicher Grundsätze und Ziele doch entscheidend vorangekommen.
Einbeziehung der Nutzer und Interessengruppen
Die Gruppe legt großen Wert auf Transparenz und wird auch künftig nationale und regionale Interessengruppen sowie Vertreter der Nutzerkreise einbeziehen.
