New referral about claim interpretation now pending under G 1/26 (Coated steel strips).

The oral proceedings in case G 1/25 (“Hydroponics”) before the EPO Enlarged Board of Appeal will be held on 8 May 2026.

After withdrawal of all appeals, appeal proceedings may not be continued with a third party who intervened during the appeal proceedings.

New referral to the Enlarged Board of Appeal on the need to adapt the description to amended claims, pending under: G 1/25 (Hydroponics).

A product put on the market cannot be excluded from the state of the art only because its composition or internal structure cannot be reproduced.

The description and drawings must always be consulted to interpret the claims when assessing the patentability of an invention.

12 March 2025.

The oral proceedings in case G 1/24 (“Heated aerosol”) before the EPO Enlarged Board of Appeal will be held on 28 March 2025.

New referral to the Enlarged Board on the status of an intervener now pending under G 2/24 (“Skin cleanser”).

The oral proceedings in cases G 1/22 and G 2/22 ("Entitlement to priority") before the EPO Enlarged Board of Appeal will be held on 26 May 2023. The public and members of the media will be able to follow the proceedings online via live stream.
